On the 10th November 2022, it was announced that employees will soon be able to access 10 days of paid family and domestic violence leave in a 12-Month period.
Previously, the ATO stated that the FDV leave needed to be implemented as per the dates below:
From 1 February 2023, for employees of non-small business employers (employers with 15 or more employees on 1 February 2023).
From 1 August 2023, for employees of small business employers (employers with less than 15 employees on 1 February 2023).
The ATO has now advised that they will allow a grace period until the 4th June 2023 to give employers time to update their payroll systems. Further information about pay slip requirements can be found at Fair Work Ombudsman.
For more information, see the Family and Domestic Violence Leave (FDVL) section on the ATO page: Reporting the amounts you have paid.
See the details below for the relevant information, setups, and tracking and reporting methods.
Payslip related information
From 1 February 2023, there are rules about information that must not be included on an employee’s pay slip relating to paid family and domestic violence leave. This is to reduce the risk to an employee’s safety when accessing paid family and domestic violence leave.
Employers need to keep a record of leave balances and any leave taken by employees. However, pay slips must not mention family and domestic violence leave, including any leave taken and leave balances.
For more information, see the Paid family and domestic violence leave on pay slips section on the Fair Work Ombudsman page: Pay Slips.
